Terms of Service
Version 1.1 · In effect from October 29, 2026
These Terms of Service (the Terms) are the agreement between your agency (you) and MW Marketing Partners LLC, a Wyoming limited liability company, 30 N Gould St #45421, Sheridan, WY 82801, United States (we). They govern your use of GodSetter, the voice AI platform at www.god-setter.com and app.god-setter.com (the Service).
The billing rules below describe what the Service actually does: the amounts, limits and dates on this page are read from the same code that applies them.
1. The Service
GodSetter lets an agency run AI voice agents that call the leads of its clients (the sub-accounts of its CRM), take their calls and book appointments on the clients’ calendars.
The Service is for businesses only. You must be at least 18 years old and, if you accept on behalf of a company, authorised to bind it.
2. Accepting these Terms
You accept these Terms by ticking the acceptance box at registration and on the card form. We record the version you accepted and the date when you complete the card form.
This is version 1.1, in effect from October 29, 2026. Version and date are shown at the top of this page, and every new version gets a new number.
3. Your account
Give us accurate details and keep them up to date. The owner of the agency account is responsible for everything done with it, including by the team members it invites. Keep your credentials safe and tell us at once about any unauthorised access.
4. Payment card
Every agency must add a payment card when it registers, also before paid billing starts. Until a card is saved, the console asks for it and no call starts: leads that arrive meanwhile are not called and are not kept for later. The same applies while the subscription is closed.
The card is collected by Stripe, our payment processor. Card data never reaches GodSetter servers: we only keep the brand and the last four digits to show them to you.
We may exempt agencies that we run ourselves. An exempt agency is never charged and needs no card. If an exemption ends, the agency must add a card and its monthly fee starts that day.
5. Start of paid billing
Until the start date of paid billing that we announce, nothing is charged, whatever your activity.
We announce the start date by email to all agencies at least 14 days in advance. On that date the monthly fee starts by itself for every agency that is not exempt. Before that date you can cancel at no cost. An agency that registers after the announcement sees the start date when it registers and receives the same email within minutes.
An agency that registers after the start date pays from the day it adds its card. There is no free trial.
6. Prices, taxes and invoices
Prices are in euros and do not include VAT. We are a US company and our invoices carry no VAT.
For customers in the European Union, VAT is accounted for by you under the reverse charge. Your invoices state: “Reverse charge: VAT to be accounted for by the recipient under Article 196 of Council Directive 2006/112/EC.”
Outside the European Union, any local tax on your purchase is your responsibility.
Payments are processed by Stripe and charged automatically to your saved card. You find your invoices in Settings.
7. Monthly fee
The Service costs a monthly fee of €29, charged at the start of each billing period. It is due for every period of your subscription, even if no client is worked in it, with these exceptions: an exempt agency pays nothing (see “Payment card”), the fee is paused during a suspension (see “Suspension by GodSetter”), and the unpaid fee of a period without calls is cancelled when the subscription closes (see “Unpaid for a long time”).
The fee includes the first client worked in the period: the first, by time, whose real call starts in it.
The billing period is the period of your subscription, not the calendar month. It starts on the day your subscription starts (the start date of paid billing, the day you add your card if you register later, or the day you reactivate) and renews every month on the same day.
8. Worked clients
A client is worked in a period when at least one real call for one of its leads takes place in that period:
- an outbound call started by one of your agents, even if nobody answers;
- an inbound call received by one of your agents: it counts when the system accepts the call.
Reminders, appointment recovery calls, retries and agreed callbacks are real calls and count. Test leads and test calls from the browser do not count. A lead that is saved but never called does not count.
You pay nothing in advance for clients: a client worked in the last period and idle in this one costs nothing.
9. Additional clients
Every client worked in a period after the included one costs €10 for that period.
We charge it to your card right after its first real call of the period starts. The call does not wait for the payment.
Each of these charges has its own invoice, with one line naming the client and the month, for example “Client Acme — October 2026”. A client is charged at most once per period, however many calls it has.
10. Unpaid charges
There are no grace days. A payment that needs an authentication step (3D Secure) counts as unpaid until you complete it from Settings.
If the €10 charge of a client is not paid, until it is paid, also after the end of the period:
- that client makes no further calls;
- no new client can start its first call: the call is declined before dialling;
- the clients already worked in the current period keep working.
If the monthly fee is not paid, no call starts for any client until it is paid.
If the first fee of a subscription (at the start of paid billing or at a reactivation) is not paid, no call starts until you update your card. If it is not paid within about 23 hours, that invoice lapses and the fee starts again when you update your card.
A call already in progress is never interrupted. Leads stopped by an unpaid charge are parked, with the reason shown on the lead, and restart by themselves once you pay: first calls that entered the queue in the last 48 hours, retries within 48 hours of the first block, callbacks within 48 hours of the agreed time, and reminders of appointments that are still ahead. The rest is discarded and closed as “expired while the payment was overdue”.
When you update your card in Settings, or pay from the link of the invoice, we collect what is due and calls start again.
11. Unpaid for a long time
If the monthly fee stays unpaid, Stripe retries it automatically for about two weeks. After that the subscription is closed, your agency shows as cancelled and no new fees are created, so the debt does not grow.
An unpaid client charge does not close the subscription: it remains due and is collected when you update your card or pay from the link of its invoice.
You only owe what was used. When the subscription closes, for non-payment or cancellation, the unpaid fee of a period in which no call was started or received is cancelled. The unpaid client charges and the fees of periods with at least one call remain due.
To start again, you pay these amounts; a new subscription then starts with the fee of the current period.
12. Cancellation
The owner of the agency account can cancel from Settings. The cancellation takes effect at the end of the period already paid. Until then everything works as usual, new clients included, each with its €10 charge.
From the next period no call starts and no fee is charged. New and queued leads are not called, are not kept for later and are closed as “subscription canceled”.
There are no refunds, of the fee or of client charges, for the rest of a period.
If you cancel before the start date of paid billing, your agency is closed at once, at no cost, and no fee starts for it.
You can withdraw a cancellation before the period ends. A closed agency can be reactivated from Settings once any amount due is paid.
13. Test leads
Test leads let you try an agent with a real call. They are not billed, so each agency can make at most 10 test-lead calls per day (Italian time): the first call of a test lead and each of its retries and callbacks count. The payment blocks above apply to them as to any other call.
14. Suspension by GodSetter
We may suspend an agency that breaches these Terms, puts the Service at risk, or when the law requires it. While the agency is suspended no call starts, test calls included, and the monthly fee is paused; it resumes when the agency is reactivated and, if the fee of the current period was cancelled during the suspension, a new billing period starts that day.
15. Refunds and billing errors
Charges are final: we do not refund fees or client charges, also when the Service is not used in a period.
If you believe we charged you by mistake, for example twice for the same client in a period, write to mwmarketingpartners@outlook.it within 30 days of the charge. We correct real billing errors within 30 days of your report.
Please contact us before opening a dispute with your bank. Opening a chargeback without contacting us first is a breach of these Terms.
16. Your calls and your leads’ consent
You decide who is called, when, by which agent and with which words. You are responsible for every call made or received through your account, and for the leads and data that you and your clients bring into the Service.
Before your agents call a lead, you make sure that:
- the lead has given the consent the law requires for automated or AI calls and has not objected;
- the number is not on a do-not-call register that applies to you, or you are allowed to call it anyway;
- the lead is told what the law requires, for example that the voice is artificial or that the call is recorded;
- the calling hours, caller ID and telemarketing rules of the lead’s country are respected.
AI agents can make mistakes. Check your prompts, your calendars and the outcomes of your calls.
17. Data processing agreement
This section is the data processing agreement required by Article 28 of the GDPR. It covers the data of your leads and contacts, their calls, recordings and transcripts: you are the controller of these data and we process them for you as processor. In particular:
- we process them only on your documented instructions, which are these Terms, your settings and your use of the Service, and we tell you if an instruction seems to us to break the law;
- the people who work on the Service are bound to confidentiality;
- we apply the security measures described in the Privacy Policy;
- our sub-processors are listed in the Privacy Policy; we tell you by email before adding a new one, and if you object you can cancel;
- we help you answer the requests of data subjects and meet your security duties, as far as the Service allows;
- we notify you of a personal data breach without undue delay once we become aware of it;
- when the Service ends, on your request we delete or return the data within 30 days, unless the law requires us to keep them;
- on reasonable request we give you the information needed to show that we comply with this section, and we allow reasonable audits with fair notice;
- transfers outside the European Union take place only with adequate safeguards, as described in the Privacy Policy.
18. Acceptable use
You must not:
- use the Service for unlawful, misleading, harassing or abusive calls, or to offer illegal products or services;
- call people who asked not to be contacted;
- open more accounts or use other workarounds to avoid charges, limits or a suspension;
- copy, decompile or attack the Service, or load it beyond normal use;
- use the Service in a way that exposes us or our providers to sanctions or account closures.
We may restrict or suspend an account that breaks this section. A suspension for this reason gives no right to a refund.
19. Retell, Twilio, GoHighLevel and other services
The Service works through services that you connect with your own accounts: Retell (voice AI), Twilio (phone numbers and calls), GoHighLevel (CRM and calendars) and, if you choose, OpenAI for writing prompts. You pay these providers directly, under their own terms; their costs are not included in our prices.
We are not responsible for their outages, their prices or their decisions about your accounts with them.
20. Your data and our intellectual property
Your data stays yours: leads, prompts, recordings, transcripts and the rest of your content. You allow us to store and process it only to provide the Service, as described in the Privacy Policy.
You confirm that you have the rights and the consents needed for the data you bring into the Service.
The software, the GodSetter brand and the documentation belong to MW Marketing Partners LLC or its licensors.
21. No guarantees
The Service is provided as it is and as available. We do not promise that it will be uninterrupted or free of errors, nor any result, such as a number of appointments.
22. Limitation of liability
As far as the law allows, we are not liable for indirect or consequential damage, such as lost profits, lost leads or lost data.
Our total liability for all claims is limited to the amounts you paid us in the 12 months before the event that caused the claim.
These limits do not apply where the law forbids them, for example in case of fraud or wilful misconduct.
23. Indemnity
You will hold us harmless from claims, fines and costs caused by your calls, your content, your clients’ data, or your breach of these Terms or of the law, including telemarketing and privacy law.
24. Termination
You can stop at any time by cancelling from Settings (see “Cancellation”). We may close or suspend your account if you breach these Terms, do not pay or expose the Service to a serious risk.
To have the data of your agency deleted, write to mwmarketingpartners@outlook.it: we delete them within 30 days, unless the law requires us to keep them.
25. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods does not apply.
Any dispute is settled by binding arbitration of the American Arbitration Association under its Commercial Arbitration Rules, in Sheridan, Wyoming, or by video conference. Either party may still ask a court for urgent measures to protect its intellectual property.
Disputes are brought individually, never as a class or representative action.
Nothing in these Terms removes rights that the law of your country does not allow you to waive.
26. Changes to these Terms
We may update these Terms. For material changes we write to you at least 30 days before they take effect, and the new version gets a new number and a new effective date. If you keep using the Service after that date, you accept the new version; if you do not agree, you can cancel before it.
27. Other provisions
These Terms and the Privacy Policy are the whole agreement between us about the Service. If a clause is invalid, the others remain in force. Not enforcing a right does not waive it. You may not transfer these Terms without our consent; we may transfer them together with our business. Neither party is liable for delays caused by events beyond its reasonable control.
